da, FARA. mene zanima taj deo o restriktivnosti. u FARA zakonu ne pominje se nijedna mera ograničenja, a službeno tumačenje zakona izričito kaže da se ovaj zakon ne bavi samim lobiranjem.

 

ako postoji još neki propis koji ograničava registraciju i delovanje stranih NVO, bilo bi dobro da ga vidimo. FARA to ne radi.

da, u zemlji u kojoj koliko-toliko vlada pravo, znaci gde nije pravilo, nego izuzetak (ne kazem da se ne desava) da biznis miniraju iz politickih razloga, ti imas nacina da preko lokalnih biznismena finansiras ovo ili ono, a posebno medije. Opet ima i ovo o vlasnistvu od 80% ( http://www.law.cornell.edu/uscode/text/22/611 ), dok u Rusiji i neko kome vrednost inostranih donacija od 1% ukupnih mora da napise na recimo stampanom izdanju da je "inostrani agent". Na kraju krajeva, 1 RT je uspeo da emituje program iz Vasingtona. Mada, realno, cela NGO gungula u Rusiji (kao nekada u Srbiji) zapravo i dobija ovakav oblik usled teskih falinski samog sistema.

Federal Election Campaign Act

The ban on political contributions and expenditures by foreign nationals was first enacted in 1966 as part of the amendments to the Foreign Agents Registration Act (FARA), an "internal security" statute.  The goal of the FARA was to minimize foreign intervention in U.S. elections by establishing a series of limitations on foreign nationals.  These included registration requirements for the agents of foreign principals and a general prohibition on political contributions by foreign nationals.  In 1974, the prohibition was incorporated into the Federal Election Campaign Act (the FECA), [HTML] [PDF] giving the Federal Election Commission (FEC) jurisdiction over its enforcement and interpretation.

The Prohibition

The Federal Election Campaign Act (FECA) prohibits any foreign national from contributing, donating or spending funds in connection with any federal, state, or local election in the United States, either directly or indirectly.  It is also unlawful to help foreign nationals violate that ban or to solicit, receive or accept contributions or donations from them.  Persons who knowingly and willfully engage in these activities may be subject to fines and/or imprisonment. 

Who is a Foreign National?

The following groups and individuals are considered "foreign nationals" and are, therefore, subject to the prohibition:

• Foreign governments;
• Foreign political parties;
• Foreign corporations;
• Foreign associations;                                   
• Foreign partnerships;
• Individuals with foreign citizenship; and
• Immigrants who do not have a "green card."

Any person who willfully violates any provisions of this Act or any regulations thereunder, or in any registration statement or supplement thereto or in any other documents filed with or furnished to the Attorney General under the provisions of this Act willfully makes a false statement of a material fact or willfully omits any material fact required to be stated therein or willfully omits a material fact or a copy of a material document necessary to make the statements therein and the copies of documents furnished therewith not misleading, shall, upon conviction thereof, be punished by a fine of not more than $10,000 or by imprisonment for not more than five years.  For some offenses the punishment shall be a fine of not more than $5,000 or imprisonment for not more than six months, or both.

Any alien who shall be convicted of a violation of, or a conspiracy to violate, any provisions of this Act or any regulation thereunder shall be subject to deportation.
