Folsom Naval Reservist is Sentenced After Pleading Guilty to Unauthorized Removal and Retention of Classified Materials

SACRAMENTO, CA—Bryan H. Nishimura, 50, of Folsom, pleaded guilty today to unauthorized removal and retention of classified materials, United States Attorney Benjamin B. Wagner announced.

U.S. Magistrate Judge Kendall J. Newman immediately sentenced Nishimura to two years of probation, a $7,500 fine, and forfeiture of personal media containing classified materials. Nishimura was further ordered to surrender any currently held security clearance and to never again seek such a clearance.

According to court documents, Nishimura was a Naval reservist deployed in Afghanistan in 2007 and 2008. In his role as a Regional Engineer for the U.S. military in Afghanistan, Nishimura had access to classified briefings and digital records that could only be retained and viewed on authorized government computers. Nishimura, however, caused the materials to be downloaded and stored on his personal, unclassified electronic devices and storage media. He carried such classified materials on his unauthorized media when he traveled off-base in Afghanistan and, ultimately, carried those materials back to the United States at the end of his deployment. In the United States, Nishimura continued to maintain the information on unclassified systems in unauthorized locations, and copied the materials onto at least one additional unauthorized and unclassified system.

Nishimura’s actions came to light in early 2012, when he admitted to Naval personnel that he had handled classified materials inappropriately. Nishimura later admitted that, following his statement to Naval personnel, he destroyed a large quantity of classified materials he had maintained in his home. Despite that, when the Federal Bureau of Investigation searched Nishimura’s home in May 2012, agents recovered numerous classified materials in digital and hard copy forms. The investigation did not reveal evidence that Nishimura intended to distribute classified information to unauthorized personnel.

This case was the product of an investigation by the Naval Criminal Investigative Service (NCIS) and the Federal Bureau of Investigation. Assistant United States Attorney Jean M. Hobler prosecuted the case.

Bryan Nishimura, 50, turned over personal media containing classified materials and was ordered by U.S. Magistrate Judge Kendall J. Newman to surrender any currently held security clearance and to never again seek such clearance.

The maximum he could have received was a year in prison and a $100,000 fine.

 

Nishimura admitted to FBI and Naval Criminal Investigative Service agents that he had transferred approximately 200 megabytes of classified data and satellite imagery to his personal electronic equipment while in Afghanistan, had traveled within that country carrying the equipment containing the data and had returned to the United States with the data in May 2008, the court papers say.

 

He also told agents that he had “destroyed and disposed of personal electronic devices and storage media containing ... classified data between approximately February and April 2012,” immediately after his initial statement to Navy personnel. He “admitted that he knew that the manner in which he had destroyed these United States classified records was not a method approved or sanctioned by the U.S. Navy,” according to the court papers.

 

“He threw the stuff in the middle of Folsom Lake, but that didn’t count,” an exasperated defense lawyer William Portanova said. “Apparently the government has its own special way of throwing things away.”

 

“This is a nothing ... of a nothing,” Portanova said when he learned the U.S. attorney’s office had issued a press release on Wednesday’s action that ended the case. “The innocent mishandling of classified data is apparently something the government cares about so long as you’re not a candidate for the presidency,” he said in reference to the furor over potentially classified emails to and from Democratic presidential candidate and former Secretary of State Hillary Clinton on her personal server. She has not been charged with a crime.

 

Justice was swift for Nishimura. The U.S. attorney’s office charged him Friday with “unauthorized removal and retention of classified documents and material,” a misdemeanor. He made his first and only court appearance Wednesday, when he pleaded guilty and was sentenced.

 

A consensual search by federal agents of Nishimura’s Folsom property in May 2012 turned up “classified and unclassified military records, stored both digitally and in hard copy,” according to court papers. Included in the material were “at least four digitally stored classified U.S. Army records dating from (Nishimura’s) 2007-2008 Afghanistan tour.”

Dragi moj WTF, izbori u USA i te kako uticu na vecinu sveta. Daleko da prizivam Tramparu, on je klovn i dvorska luda monumentalnih proporcija - ali ako je Hilari najbolje sto Amerika i demokrate mogu da ponude, onda mogu samo da najavim da ce sledeci izbori biti zaista izmedju Trampare i nekog jos ludjeg kandidata.

Jok, nego cu da ozbiljno raspravljam izbore sa likom sa Novog Zelanda koji zaista veruje da ce da proda vise djirlo kuraca palaca ako u Americi pobedi kandidat X umesto kandidata Y. U to ime zivelo zezanje, a ozbiljne postove razmenjujem sa ljudima koji to zasluzuju; sa Rodjerom, Indijem i WTFom.

Republikanski kandidat za predsedničke izbore u SAD Donald Tramp ponovo je pohvalio nemilosrdnost bivšeg predsednika Iraka Sadama Huseina rekavši da je "tako dobro" ubijao teroriste.

"Sadam Husein je bio loš momak, zar ne?.. Ali znate šta je dobro radio? Ubijao teroriste. Radio je to tako dobro", rekao je Tramp u Raliju, glavnom gradu američke države Severna Karolina.

Tramp je dodao da njima "nisu čitana prava".

Tramp je ranije već hvalio Huseina i lidera Libije Moamera Gadafija, ocenjujući da bi svet bio "100 odsto bolji" da su oni još na vlasti.

Izbori u SAD se ne ticu samo ljudi koji tamo zive, vec direktno i indirektno uticu na ceo svet. Nazalost samo gradjani SAD imaju pravo glasa, a mi ostali gradjani sveta smo taoci njihovih (najcesce vrlo losih) odluka.

Sto se tice zabave/cirkusa, to su takodje napravili gradjani SAD svoji politickim delovanjem i preliminarnim izborima! Izbor izmedju Trampa i Kilari je komendija, a ne izborna trka u najuticajnioj zemlji na nasos planeti.
